Gretchen Whitmer on Feb. 20, 2025 signed House Bill 4002, bringing some revisions to Michigan\u2019s Earned Sick Time Act, known as ESTA. These changes took effect Feb. 21 for most businesses and impact how dental offices manage employee sick leave.<\/p>\n<h3>Key Changes that Affect Dental Practices<\/h3>\n<p><strong>Small Businesses (10 or fewer employees):<\/strong><\/p>\n<ul>\n<li>Employees accrue one hour of sick time per 30 hours worked, capped at 40 hours of paid leave per year (no unpaid leave).<\/li>\n<li>These businesses will not have to comply with ESTA until Oct. 1, 2025.<\/li>\n<\/ul>\n<p><strong>Larger Businesses (11 or more employees):<\/strong><\/p>\n<ul>\n<li>Employees accrue up to 72 hours of paid sick leave annually.<\/li>\n<\/ul>\n<p><strong>Employers Can Use PTO to Meet These Requirements: <\/strong><\/p>\n<ul>\n<li>Businesses may offer paid time off policies that meet or exceed the above thresholds.<\/li>\n<li>Some confusion remains regarding how this applies \u2014 further clarification may be needed.<\/li>\n<\/ul>\n<p><strong>Improved Employer Protections:<\/strong><\/p>\n<ul>\n<li>The new law removes the automatic presumption of employer guilt in disputes which was part of the original legislation.<\/li>\n<li>Employees can no longer go directly to court if they believe an employer violated the law. Sick Time Act: What Dental Practices Need to Know<\/h2>\n<p>Updated: Feb. 26, 2025<\/p>\n<p>Gov. Gretchen Whitmer on Feb. 20, 2025 signed House Bill 4002, bringing some revisions to Michigan\u2019s Earned Sick Time Act, known as ESTA. These changes took effect Feb. 21 for most businesses and impact how dental offices manage employee sick leave.<\/p>\n<h3>Key Changes that Affect Dental Practices<\/h3>\n<p><strong>Small Businesses (10 or fewer employees):<\/strong><\/p>\n<ul>\n<li>Employees accrue one hour of sick time per 30 hours worked, capped at 40 hours of paid leave per year (no unpaid leave).<\/li>\n<li>These businesses will not have to comply with ESTA until Oct. 1, 2025.<\/li>\n<\/ul>\n<p><strong>Larger Businesses (11 or more employees):<\/strong><\/p>\n<ul>\n<li>Employees accrue up to 72 hours of paid sick leave annually.<\/li>\n<\/ul>\n<p><strong>Employers Can Use PTO to Meet These Requirements: <\/strong><\/p>\n<ul>\n<li>Businesses may offer paid time off policies that meet or exceed the above thresholds.<\/li>\n<li>Some confusion remains regarding how this applies \u2014 further clarification may be needed.<\/li>\n<\/ul>\n<p><strong>Improved Employer Protections:<\/strong><\/p>\n<ul>\n<li>The new law removes the automatic presumption of employer guilt in disputes which was part of the original legislation.<\/li>\n<li>Employees can no longer go directly to court if they believe an employer violated the law. This new law will most likely cause major changes in your office pertaining to employee sick time, so it\u2019s critical that you understand the provisions of this new law.<\/p>\n<p>Key points of ESTA include the following:<\/p>\n<ul>\n<li>All employers, regardless of size, will be required to offer paid sick time to all employees, regardless of status. Full-time, part-time, temporary, seasonal, hourly, salary and even independent contractors are eligible to begin accruing paid sick time as of Feb. 21, 2025.<\/li>\n<li>Employees will earn one hour of paid sick time for every 30 hours worked. There is no cap on the number of hours an employee can earn in a given week, month, or year. Employers will need to work with their payroll and timekeeping systems to prepare for this change. Employees are eligible to begin accruing paid sick time immediately upon hire, but employers can impose a 90-day wait period before employees can use their accumulated time.<\/li>\n<li>Employees can use up to 72 hours of paid sick time each year, assuming they have accrued at least that amount. Employers can define how the \u201cyear\u201d is calculated \u2014 calendar year, anniversary year, fiscal year, etc. Employers with nine or fewer employees can award 40 of the 72 hours as <em>paid<\/em> time off and the remaining 32 hours as <em>unpaid<\/em> time off. Employers with 10 or more employees must award all 72 hours as paid time off.<\/li>\n<li>Employees must be able to take paid sick time in the smallest increment of time that the employer\u2019s payroll system allows for, but no more than one-hour increments. This could lead to employees using time in one-minute increments based on the capabilities of your payroll provider.<\/li>\n<li>While there is no cap on the amount of unused paid sick time an employee can carry over from year to year, there is a cap on annual use (72 hours), and there is no requirement that unused sick time be paid out.<\/li>\n<li>Paid sick time can be used for a broad range of reasons, with little to no notice requirements and limitations on the documentation an employer can request to substantiate the leave.<\/li>\n<li>Employees cannot be penalized in any way for using their earned sick time.<\/li>\n<li>Employers must provide written notice of this act to all employees, including new hires, that outlines the amount of paid sick time provided and how it is calculated, terms of use, non-retaliation language and a reminder that employees can bring a lawsuit against the employer if they feel these obligations have not been sufficiently met.<\/li>\n<li>Employees have a private right of action under this act, meaning they can sue their employer without going through any other complaint procedure first.
